Bernard Kamine graduated from Harvard Law School in 1968 after receiving his undergraduate degree at the University of Denver. A government attorney from 1968 to 1974, he has since focused on construction industry dispute avoidance and resolution. He wrote Public Works Construction Manual: A Legal Guide for California (BNi Building News, 1996), co-wrote "Chapter 22, Construction Contracts" in 2 California Forms of Jury Instruction (Matthew Bender, 1985, repub'd 1997), and has written or co-written numerous articles for the Los Angeles Daily Journal and the Engineering Contractors' Association Magazine. He has taught courses and seminars throughout Southern California: for the Engineering Contractors' Association (where he is a member of the Board of Directors and Legal Counsel); the Associated General Contractors of California; Building News, Inc.; and many others. He has served on the “Greenbook Committee” – which writes the Standard Specifications for Public Works Construction – for more than twenty years. He has written over a dozen bills that have been enacted into law, and continues to work on legislation that will benefit the construction industry. He is also admitted to the Colorado Bar.
He regularly serves as an arbitrator and mediator in construction cases. Both Best Lawyers in America and Southern California Super Lawyers recognized him as a construction industry lawyer, the Los Angeles County Bar Association gave him its biennial James Acret Award for Outstanding Achievement in Construction Law Legal Writing, and the Engineering Contractors' Association gave him its annual D.I.G. Award for demonstrating dignity, integrity and generosity in his work with the construction industry.
Marcia Haber Kamine completed her undergraduate studies at the University of California, San Francisco, and received her law degree, cum laude, from Southwestern University College of Law. After more than 30 years in the Los Angeles City Attorney's Office, where she tried over 50 jury trials to verdict, she retired as an Assistant City Attorney and joined the firm. For 20 years, she had been assigned to the Civil Branch, General Counsel and Special Litigation sections, where she represented the city on all aspects of public works construction, including bid protests, bidder responsibility hearings, subcontractor substitution hearings, and trials and appeals in both state and federal courts. Her cases involved Hyperion Sewage Treatment Plant, NORS, police stations, libraries, and the Convention Center Expansion. She also advised Parks and Recreation, the Police Department and the Fire Department on procurement contract issues. For the last 10 years, she had been assigned to Water and Power, advising the Board of Water & Power Commissioners, developing standard terms and conditions for all computer-related contracts used by the department and advising on energy related regulatory and procurement matters. She is an arbitrator and mediator on the American Arbitration Association National Construction Panel and is also on the AAA Large Complex Case Panel. She has been the sole arbitrator in over 250 construction cases and has mediated approximately 15 cases. She co-wrote "Chapter 22, Construction Contracts" in 2 California Forms of Jury Instruction (Matthew Bender, 1985, repub'd 1997), writes papers on government procurement issues and regularly makes presentations to construction industry groups. She has also been very involved in community organizations, including Boy Scouts and citizen advisory panels for the expenditure of public works bond money.
Daniel J. Phelps came to the practice of law with over 20 years of experience managing construction projects and construction companies. As part of this experience Mr. Phelps owned and operated a construction company that focused on the construction of water facilities and still maintains a California license for general engineering and general building construction. Mr. Phelps also worked as a scheduling consultant for owners and contractors on projects ranging up to $300 million, focusing on baseline schedule development, schedule maintenance, and providing delay and claims analysis. Mr. Phelps received his BS in Construction Management from Arizona State University in 1987 and his JD from Western State University College of Law.
